The Probate Court of Gilmer County is committed to providing you with excellent customer service. We
serve the interests of the citizens of this county by performing its unique constitutional duties in a
manner that is professional, impartial, compassionate, and fiscally responsible.

Scott C. Chastain is Judge of the Probate Court in Gilmer County

Probate Courts have exclusive jurisdiction over the probate of wills, the administration of estates, the
appointment of guardians and conservators for incapacitated adults and minor children, and
commitments to involuntary evaluation and treatment for people with mental, drug or alcohol issues.
The Probate Court also issues marriage and weapons carry licenses and also performs a number of
administrative duties which have been assigned to the Court over time. If you need a copy of a birth or
death certificate, Judge Chastain also serves as the local Registrar and Custodian of Vital Records for
Gilmer County.

Probate Court Judges may hold habeas corpus hearings or preside over criminal preliminary hearings. If
a jury trial is not requested, Probate Court Judges may also hear certain misdemeanors, traffic cases and
violations of state game and fish laws in counties where there is no state court. Probate Judges
administer oaths of office and when authorized by local statute, Probate Judges serve as Election
Superintendents and make appointments to certain local public offices. Judge Chastain is currently
serving as the Election Superintendent of Gilmer County.

however, that state law prohibits our staff from rendering legal advice, restating the law or

Search for Local Courts and under Probate Courts, pick Gilmer County. You will then be able to access
valuable information about wills and probate in general, as well as links to downloadable forms.

Weapons Carry License applications are accepted Monday - Friday from 8:30 a.m. to 4:30 p.m. Please
arrive no later than 4:15 in order to allow for adequate time to complete the application. Applications
may be picked up at the office of Probate Court in Gilmer County or you can go to
Weapons Carry License Application and start your application there. You will still need to come to our
office to complete the application but some of your information should already be in the system.

Marriage License Applications are accepted Monday - Friday from 8:30 a.m. to 4:30 p.m. Please arrive
no later than 4:15 in order to allow for adequate time to complete the application. Applications may be
picked up at the office of Probate Court in Gilmer County or you can go to Marriage License Applications
and start your application there. You will still need to come to our office to complete the application but
some of your information should already be in the system.

 

You can pay your traffic tickets online.

In an effort to further serve our community, Judge Scott C. Chastain and staff announces that the
Probate Court of Gilmer County is now accepting Visa and MasterCard credit card and debit card
payments. A driver's license along with the card will need to be presented at the front window to verify
cardholder. A small convenience fee will be added to the court fees or fines. Also, you now have the
ability to pay your traffic citation in the courtroom during traffic court. The process is quick, easy and
convenient. This service is provided by EZCourtPay, LLC.
